LOS ANGELES (Legal Newsline) — Two California men are suing Wells Fargo Bank and others, alleging fraud, negligent misrepresentation and violation of federal law.
Daniel Friedman of Los Angeles County and James Hernandez of Riverside County filed a class action complaint, individually and on behalf of all others similarly situated, Oct. 3 in U.S. District Court for the Central District of California against Wells Fargo Bank, N.A., Wells Fargo & Company and Does 1 through 6,300, alleging they opened customer accounts without their approval or consent.
According to the complaint, Friedman and Hernandez suffered damages from having their identity used without their consent by Wells Fargo. The plaintiffs allege the defendants opened and enrolled customers to their services without their knowledge.
Friedman and Hernandez seek trial by jury, compensatory and special damages, punitive and exemplary damages, restitution and disgorgement, all legal fees and any other relief the court deems just.
