WASHINGTON (Legal Newsline) — A Minnesota consumer group is suing egg distributors, alleging false and misleading representations.

Organic Consumers Association of Finland, Minnesota, filed a class action complaint on behalf of the general public Sept. 26 in U.S. District Court for the District of Columbia against Handsome Brook Farm, LLC and Handsome Brook Farm Group 2 LLC and Doe Corporation 1-10, alleging violation of the District of Columbia Consumer Protection Procedures Act.

According to the complaint, the plaintiff has suffered and will continue to suffer financial harm if defendants' pasture-raised eggs continue to be sold as is. The plaintiff alleges the defendants purchased their eggs in the open market, without regard to whether those eggs come from pasture-raised hens, and deceptively packaged, marketed and labeled their eggs as pasture-raised eggs without any qualifications.

Organic Consumers Association seeks trial by jury, an order declaring the defendants' conduct violated DCCPA, court costs, attorney fees and expert fees, pre-judgment interest and all further relief the court deems just. It is represented by attorneys Sanjay S. Karnik of Amin Talati Upadhye LLP in Chicago, Kim Richman of The Richman Law Group in Brooklyn, New York, and Carter Dillard of the Animal Legal Defense Fund in Cotati, California.
