Stockholder alleges Medivation, board violated federal law

SAN FRANCISCO (Legal Newsline) - A stockholder is suing a company and its board, alleging negligent misrepresentation and violation of federal law.

David Klein filed a class action complaint, individually and on behalf of all others similarly situated, Sept. 7, in U.S. District Court for the Northern District of California against Medivation, Inc., David T. Hung, Kim D. Blickenstaff, Kathryn E. Falberg, Michael L. King, Patrick Machado, Dawn Svoronos, W. Anthony Vernon and Wendy L. Yarno, alleging they disclosed misleading statements to the common stockholders regarding a proposed merger with Pfizer.

According to the complaint, Klein suffered financial damages after being presented with false information regarding the proposed merger of Medivation with Pfizer. 

Klein seeks trial by jury, enjoining the defendant, the consummation of the proposed transaction, the award of damages to the plaintiff and the class, legal fees and all other relief the court deems just. He is represented by attorneys Barbara A. Rohr, Benjamin Heikali and Nadeem Farqui of Faruqi & Faruqi LLP in Los Angeles and New York, and by Juan E. Monteverde of Monteverde & Associates PC in New York.
