LOS ANGELES (Legal Newsline) - A California consumer is suing health insurance marketers, alleging telephone harassment.
Alexios Kafatos of Anaheim, California, filed a class action complaint, individually and on behalf of all others similarly situated, Sept. 19 in the U.S. District Court for the Central District of California against
DirectHealth.com LLC, TZ Insurance Solutions LLC and Does 1-10,
alleging violation of the Telephone Consumer Protection Act.
According to the complaint, on July 12 Kafatos received at least 18 calls from the defendants, attempting to solicit him to purchase their services.
The plaintiff alleges the defendants made non-emergency calls using an automatic telephone dialing system and/or an artificial or prerecorded voice. Despite revocation of any prior express consent, the defendants continued to call Kafatos, the lawsuit states.
Kafatos seeks trial by jury, $500 for each and every negligent violation, and $1,500 for each and every willful violation of TCPA, plus all other relief the court deems just and proper.
