Customer accuses retail store of false advertising

SAN FRANCISCO (Legal Newsline) — An El Dorado County woman is suing a retail store, alleging false advertising of shoes. 

Maria Ramos filed a class action lawsuit, individually and on behalf of all others similarly situated June 1 in the Superior Court of California against AM Retail Group, Inc. and Does 1-100, alleging negligent misrepresentation and unfair competition.

According to the complaint, Ramos suffered financial damages after being misled into purchasing shoes she believed to be discounted. The plaintiff alleges the defendants advertised their products to be discounted but, in reality, they artificially inflated the cost, deceiving consumers, including the plaintiff.

The plaintiff seeks trial by jury, damages, restitution, declaratory and injunctive relief, ordering the defendant to engage in a corrective advertising campaign, punitive damages, all legal fees and all other relief the court deems just. She is represented by attorneys Gene J. Stonebarger and Richard D. Lambert of Stonebarger Law, APC in Folsom, California, and by Thomas A. Kearney and Prescott W. Littlefield of Kearney Littlefield LLP in Glendale, California.

The defendant removed the case to U.S. District Court for the Northern District of California on July 29.
