Consumer accuses natural food manufacturer of misleading business practices

BROOKLYN, N.Y. (Legal Newsline) — A Nassau County woman is suing a nutritional food manufacturer, alleging deceptive and misleading business practices and unjust enrichment.

Ruth Guerra filed a class action lawsuit, individually and on behalf of all others similarly situated, Aug. 16 in U.S. District Court for the Eastern District of New York against Hero Nutritionals Inc. alleging violation of the New York General Business Law and the consumer protection statutes of all 50 states.

According to the complaint, Guerra suffered financial injury for paying a premium for Yummi Bears Gummy vitamin products that purported to be “All Natural". The plaintiff alleges the defendant misrepresented the product as all natural products when they actually contain synthetic chemicals.

Guerra seeks a trial by jury, declaration for this claim as a proper class action and certifying her as class representative, preliminary and permanent injunctive relief against the defendant, directing the defendant to correct its practices, monetary damages, punitive damages, court costs and expenses, plus all other relief the court deems proper.
