Consumers claim Nissan sells defective vehicles

LOS ANGELES (Legal Newsline) — Two consumers have filed a class action lawsuit against a vehicle manufacturer for alleged breach of warranty and fraud due to a defective timing chain tensioning system that purportedly fails prematurely.

Kathy Shaw and Hartwell Steele filed a complaint on behalf of other members of the public similarly situated on June 17 in U.S. District Court for the Central District of California against Nissan North America Inc. and Nissan Jidosha Kabushiki Kaisha, doing business as Nissan Motor Co. Ltd., alleging that they concealed to the public and consumers the defective nature of their vehicles.

According to the complaint, the plaintiffs allege that Kathy Shaw and Hartwell Steele bought a vehicle that contained a defective timing chain tensioning system. The plaintiffs hold Nissan North America Inc. and Nissan Jidosha Kabushiki Kaisha, doing business as Nissan Motor Co. Ltd., responsible because the defendants allegedly knew about the defect of the timing chain tensioning system inside their vehicles, but failed to inform the public or actively reach out to them to provide an acceptable solution.

The plaintiffs request a trial by jury and seek compensatory damages, treble damages, interest, all legal fees and any other relief as the court deems just. They are represented by Roland Tellis and Mark Pifko of Baron & Budd P.C. in Encino, California, Payam Shahian of Strategic Legal Practices APC in Los Angeles and Jordan Lurie and Cody Padgett of Capstone Law APC in Los Angeles.
