Two engineers accuse former employer of violating wage law

BOSTON (Legal Newsline) — Two Massachusetts engineers are suing a technology company, alleging violation of the company's paid time off plan.

Sumit Kumar and Randy Johnson filed a class action lawsuit, individually and on behalf of all others similarly situated, Aug. 3 in U.S. District Court for the District of Massachusetts against GE Inspection Technologies LP, alleging violation of the Massachusetts Wage Act.

According to the complaint, Kumar and Johnson earned paid time off (PTO) under the GE Inspection Technologies' plan. The suit says they were not paid the PTO money they earned during their employment. 

The plaintiffs allege GE Inspection Technologies deleted all their PTO that had been earned under the traditional policy and failed to pay their paid leaves that they had earned under the company-defined PTO policy.

Kuman and Johnson seeks a trial by jury, certification as a class action, lost wages, plus liquidated damages, attorney fees and legal costs, plus such other relief as the court deems just. They are represented by attorneys Michael Bace of Bace Law Group LLC in Boston and by John R. Bita, III of Law Office of Boston.

The defendant removed the case to U.S. District Court for the District of Massachusetts on Aug. 3.
