Ex-pro wrestler alleges WWE failed to pay royalties

HARTFORD — A former professional wrestler is suing World Wrestling Entertainment (WWE), alleging breach of fiduciary duty and unjust enrichment.

Marcus Bagwell of Woodstock, Georgia, filed a class action lawsuit, individually and on behalf of all others similarly situated, Aug. 9 in U.S. District Court District of Connecticut against World Wrestling Entertainment Inc. alleging violation of the Connecticut Unfair Trade Practices Act.

According to the complaint, in 2016, Bagwell has not received contractually owed royalty payments for certain content that has been sold or licensed by the WWE. 

The plaintiff alleges the defendant sold WCW video products on pay per views and none-pay per views without paying Bagwell any royalties and repeatedly misrepresenting the amounts rightfully owed him.

Bagwell seeks a trial by jury, certification for this complaint to proceed as a class action, compensation for punitive damages, plus interest, attorney fees, legal costs and expenses and all relief the court deems proper. He is represented by attorneys Brenden P. Leydon of Tooher Wocl & Leydon LLC in Stamford, Connecticut, and by Clinton A. Krislov and Matthew T. Peterson of Krislov & Associates Ltd. in Chicago.
