2 Texas consumers accuse Apple of fraud

SAN FRANCISCO — Two Texas consumers are suing Apple, alleging breach of contract.

Vicky Maldonado of Houston and Joanne McRight of League City filed a class action lawsuit, individually and on behalf of all others similarly situated, July 20 in U.S. District Court for the Northern District of California against Apple Inc., Applecare Service Company Inc., and Apple CSC Inc., alleging breach of contract, breach of warranty and fraud.

According to the complaint the defendants misled Maldonado and McRight into purchasing an Applecare plus plan only to be given a refurbished unit as a replacement to the computers they had returned. The suit says Maldonado and McRight suffered financial damages

The plaintiffs allege the defendants breached their warranty policy by providing refurbished units instead of new units.

Maldonado and McRight seek a trial by jury, award damages, punitive damages, reimbursement, restitution, disgorgement, court costs, interest and any further relief the court grants. They are represented by attorneys Renee Kennedy of Friendswood, Texas, and Peter Kafin of Fort Bragg, California.
