LOS ANGELES — Two consumers are suing a health care products company, alleging false advertising. 

Allison Turner of California and Allen Scioli of Michigan filed a class action lawsuit, individually and on behalf of all others similarly situated, June 17 in U.S. District Court for the Central District of California against BI Mobile Breath Inc., B.I. Incorporated and Soberlink Healthcare LLC, alleging fraud, negligent misrepresentation, product liability, and unjust enrichment.

According to the complaint, Turner and Scioli suffered damages as the result of being misled into purchasing a product thinking it was certified by the U.S. Department of Transportation. The plaintiffs allege the defendants' product was not certified by the DOT.

Turner and Scioli seek trial by jury, disgorgement and restitution, actual damages including incidental and consequential damages, punitive damages, all legal fees and any other relief the court deems just.
