Two consumers allege Ascena Retail, Ann Inc. misrepresent sales

NEW YORK (Legal Newsline) - Two women are suing the owners of clothing retail chains, alleging they misrepresented sale prices in their outlet stores.

Siobhan Morrow of California and Ashley Gennock of Pennsylvania, individually and for all others similarly situated, filed a class action lawsuit May 5 in U.S. District Court for the Southern District of New York against Ascena Retail Group Inc. and Ann Inc., alleging violation of California's Unfair Competition Law, its False Advertising Law, and its Consumer Legal Remedies Act, violation of Pennsylvania's Unfair Trade Practices & Consumer Protection Law, unjust enrichment, and violations of consumer protection laws in other states.

The suit alleges the defendants misrepresented the nature of sales at their retail outlets stores, including Ann Taylor Factory and Ann Taylor Loft Outlet stores.

The defendants, the complaint says, represented "sale" prices alongside "original" or "regular" prices, but the represented original or regular prices were artificially inflated and were never the original prices for the clothing, shoes and fashion apparel that was sold at these retail outlet stores.

The plaintiffs and others in the class seek a jury trial, damages, restitution and disgorgement, declaratory and injunctive relief, corrective advertising, attorney fees and costs. They are represented by attorneys Joseph P. Guglielmo and Erin Green Comite of Scott+Scott, Attorneys at Law in New York, and Todd D. Carpenter, Edwin J. Kilpela and Gary F. Lynch of Carlson Lynch Sweet Kilpela & Carpenter in San Diego and Pittsburgh.
