INDIANAPOLIS (Legal Newsline) – The Equal Employment Opportunity Commission (EEOC) has charged manufacturing-tooling company C&A Tool Engineering Inc. with violating the Americans with Disabilities Act (ADA).
According to EEOC, C&A Tool committed the violation when it failed to hire an applicant due to vision impairment. The applicant, allegedly an experienced and qualified machinist, was given a job offer by the company pending physical examination, according to the charges. C&A Tool then purportedly withdrew the offer because it found out about the vision impairment.
"The ADA protects both job applicants and employees from disability discrimination," Kenneth L. Bird, acting regional attorney of the Indianapolis District Office, said. "Employers cannot and should not consider impairments that do not affect job performance in their hiring decisions. EEOC will vigorously pursue cases where employers ignore this obligation."
EEOC’s lawsuit comes after it first tried to reach a pre-litigation settlement with C&A Tool through its conciliation process. EEOC will seek back pay, compensatory damages, punitive damages and injunctive relief.
