SAN FRANCISCO (Legal Newsline) - A Michigan man is suing the operator of a social network, alleging it sent unsolicited text message calls.

Terry Cour II, individually and for all others similarly situated, filed a class action lawsuit Feb. 17 in U.S. District Court for the Northern District of California San Francisco Division against Life360 Inc., alleging violations of the Telephone Consumer Protection Act (TCPA) and the California Business & Professional Code.

The suit alleges Life360 sent unauthorized text message calls to the cell phones of consumers throughout the United States, including Cour, without prior consent of the recipients. The defendant, the lawsuit states, used an automatic telephone dialing system to make the text message calls, in violation of the TCPA.

The complaint says the recipients suffered actual harm, including aggravation and nuisance.

Cour and others in the class seek actual and statutory damages, declaratory judgment, injunctive relief, disgorgement, attorney fees and costs. They are represented by attorneys Rafey S. Balabanian, Alicia Hwang, Todd Logan, Ari J. Scharg and Amir C. Missaghi of Edelson PC in San Francisco and Chicago.
