Georgia woman accuses Equity Experts of unlawful collection practices

AUGUSTA, Georgia (Legal Newsline) - A Georgia woman is suing a debt collection services, alleging it engages in unlawful debt collection practices.

Sarah Usry, individually and for all others similarly situated, filed a class action lawsuit Jan. 29 in U.S. District Court for the Southern District of Georgia Augusta Division against Equityexperts.org LLC, doing business as a Equity Experts, alleging violations of the Fair Debt Collection Practices Act, violations of Georgia usury laws, and unjust enrichment.

The suit states Equity Experts has a practice of trying to collect sums that alleged debtors, such as Usry and others in the class, do not owe, collecting sums that are usurious, sending threatening collection letters that misrepresent the amount owed, filing lawsuits for sums not owed, and filing liens not supported by law or fact against properties of alleged debtors.

Usry and other class members seek compensatory damages, injunctive relief, disgorgement, interest, attorney fees and other litigation expenses. They are represented by attorneys George G. Robertson and David E. Hudson of Hull Barrett in Augusta, Georgia. The defendant filed to transfer the case to federal court because the plaintiff alleges a cause of action under a federal law.
