New York woman alleges Babo Botanicals misrepresents products

BROOKLYN, N.Y. (Legal Newsline) - A New York woman is suing a hair and skincare products company over claims certain of its products are falsely marketed as "natural" or "all natural."

Jennifer Nicotra, individually and for all others similarly situated, filed a class-action lawsuit on Jan. 20 in U.S. District Court for the Eastern District of New York against Babo Botanicals, alleging breach of express and implied warranties, unjust enrichment, and violations of the New York General Business Law and consumer protection statutes in all 50 states.

The defendant allegedly markets several of its products as "natural" or "all natural," but the suit claims these products contain various artificial and synthetic ingredients, some of which have been associated with risks of developing health issues.

Nicotra and others in the class allegedly paid a premium price for the products the defendants represented were natural or all natural, the suit claims. 

Nicotra and others in the class seek injunctive relief, monetary and punitive damages, attorney fees, and other costs of the suit, together to exceed $5 million. They are represented by attorneys Jason P. Sultzer, Joseph Lipari and Jean M. Sedlak of the Sultzer Law Group in New York City.
