Saline Retail sued over alleged FCRA violations

JEFFERSON CITY, Mo. (Legal Newsline) – A Missouri man is suing a business alleging that it refused to hire him after it obtained results from a consumer report.

Rod Casteel, individually and for all others similarly situated, filed a class-action lawsuit Dec. 4 in Cole County Circuit Court against Saline Retail 26 LLC, doing business as Lions Den Adult Superstore, alleging violations of the Fair Credit Reporting Act.

The suit states Saline Retail obtained information about Casteel from ADP, a consumer reporting agency. Saline Retail allegedly relies on consumer report information as basis for adverse employment action, such as refusal to hire or termination, according to the suit.

The suit alleges Saline Retail told Casteel on Dec. 5, 2014, he would not be hired for an assistant manager position because of the results of his consumer report.

Furthermore, the suit alleges, Saline Retail did not provide Casteel with a copy of the report, so he was not allowed to address any possible inaccuracy in the consumer report.

Casteel and others in the class seek equitable relief, statutory and punitive damages, and attorney fees and costs. They are represented by attorneys Charles Jason Brown and Jayson A. Watkins of Brown & Associates in Gower, Missouri.

The defendant filed Jan. 6 to remove this case to the Central Division of the Western District of Missouri because the plaintiff is asserting claims governed by federal law.
