TAMPA, Fla. (Legal Newsline) – A Florida man is suing a health care company over claims it sent unsolicited facsimiles.

Steven Arkin, individually and for all others similarly situated, filed a class-action lawsuit Dec. 23 in the Tampa Division of the Middle District of Florida against The Paquin Healthcare Cos. and John Does 1-10, alleging violations of the Telephone Consumer Protection Act, as amended by the Junk Fax Prevention Act.

The suit states that on June 9, 2015, and June 17, 2015, the defendants sent two unsolicited advertisements to Arkin and others in the class. The faxes described the commercial availability and quality of the defendants' goods and services.

As a result, Arkin and the class members lost use of their fax machines, paper and ink toner. The unsolicited faxes also wasted the plaintiffs' time, interrupted their privacy, prevented their fax machines from sending and receiving authorized faxes, and caused wear and tear on their fax machines.

Arkin and others in the class seek actual monetary loss or the sum of $500 per violation, whichever is greater, plus interests and costs. They are represented by attorney Ryan M. Kelly of Anderson + Wanca in Rolling Meadows, Illinois.
