Suit alleges Eagle Eye's liquid grass seeder unable to perform as advertised

SAN DIEGO (Legal Newsline) – A California resident is suing the designer of a liquid lawn seeder over claims the product has an inherent defect that prevents it from performing as advertised.

Yossi Tiefenbrun, individually and for all others similarly situated, filed a class-action lawsuit Dec. 17 in the Southern District of California against Eagle Eye Marketing Group, alleging breach of express and implied warranties and violations of California business codes.

The suit states Eagle Eye Marketing Group designed, marketed, and sold a liquid lawn seeder called Hydro Mousse, purportedly comprised of a high-quality seed mixture and a "spray n' stay" technology designed to attach seed to the soil and reduce the seeds' water surface tension. The defendant advertises the product as a do-it-yourself, "quick and easy," professional-level way to grow grass.

However, the suit states Hydro Mousse contains an inherent defect and could not perform as advertised. As a result, Tiefenbrun and others in the class paid a price premium for a product that does not work as advertised, according to the suit.

Tiefenbrun and others in the class seek preliminary and permanent injunctive relief, restitution, equitable relief, compensatory damages, exemplary and punitive damages, interest, attorney fees and costs of the suit, together to exceed $5 million. They are represented by attorneys E. Elliot Adler and Brittany S. Zummer of Adler Law Group in San Diego.
