RENO, Nev. (Legal Newsline) – Three California residents are suing several taxi cab companies for allegedly printing more than five digits of credit/debit card numbers when the cards are used for transactions with the companies.

Brett Noble, Amanda Fowler and Larry Tran, individually and for all others similarly situated, filed a class-action lawsuit Dec. 8 in the U.S. District Court for the District of Nevada against Nevada Checker Cab, doing business as Checker Cab Co.; Henderson Taxi; Whittlesea Blue Cab Co.; Nevada Yellow Cab, doing business as Yellow Cab Co.; Nevada Star Cab, doing business as Star Cab Co.; Western Cab Co., doing business as Western Cab; and Does 1-100, alleging violations of the Fair and Accurate Credit Transactions Act (FACTA).

FACTA, enacted in 2003, provides that "no person that accepts credit cards or debit cards for the transaction of business shall print more than the last five digits of the card number..upon any receipt provided to the cardholder at the point of the sale or transaction," the complaint states.

According to the suit, merchants who accept credit and debit cards were given up to three years to comply with FACTA's requirements.

Although the defendants had up to three years to comply, they still print more than the last five digits of the card number on receipts provided to credit/debit card holders, the suit claims.

As a result, the defendants have failed to protect customers, including the plaintiffs and others in the class, against identity theft and credit/debit card fraud.

The plaintiffs and others in the class seek statutory and punitive damages, plus attorney fees and costs of the suit. They are represented by attorney Kenneth M. Roberts of Dempsey Roberts & Smith in Henderson, Nevada, and by attorney Chant Yedalian of Chant & Co. in Glendale, California.
