SAN DIEGO (Legal Newsline) - Four customers are suing a major television and Internet provider for allegedly adding hidden fees to customers' monthly bills.

Matti Yosif, Elizabeth Ioane, Zach Beimes and Dawn Harrel, as individuals and for all others similarly situated, filed a lawsuit in June California Superior Court for the County of San Diego against CoxCom, also known as Cox Communications.

The defendant removed the case to federal court in July.

According to the complaint, CoxCom offers television, Internet and phone service for customers in several states and some of the bundles offered by CoxCom can be purchased offering different services. In its advertisements, the company informs customers about monthly fees and all discounts available, the suit says.

However, for the “Advanced TV” package customers are charged additional amounts for the package, the lawsuit said.

“[CoxCom] has failed ... to disclose these additional, unauthorized fees to consumers, or that the price for Advanced TV as advertised does not include these additional, unauthorized charges,” the lawsuit said. “Instead ... [CoxCom] deliberately misleads consumers and obfuscates these additional, unauthorized charges.”

The plaintiffs seek class status for California residents who were subject to the fees during the last four years, plus damages less than $5 million and court costs. They are represented by attorneys Derrick Coleman and R. Jeffrey Neer of Coleman Frost in Santa Monica, Calif.
