DSW Shoe Warehouse faces legal action for allegedly misleading customers

RIVERSIDE, Calif. (Legal Newsline) - A consumer is suing a major shoe supplier for allegedly misleading customers about discounts it offered on its merchandise.

Marilyn Sperling, as an individual and on behalf of all others similarly situated, filed a lawsuit July 8 in U.S. District Court Central District of California-Eastern Division against DSW Shoe Warehouse, alleging unfair and fraudulent business practices.

According to the complaint, the DSW Shoe stores “deceptively” labeled its products to make it seem customers were getting a better discount than they actually would. DSW would allegedly offer a comparative price between its price and other retail prices.

The discounts would be put on the tags on the products, via in-store advertising, on the company website or in print advertising, the lawsuit said. The suit said the misleading prices violate California fair practices laws. There are about 41 retail DSW stores in the state.

Sperling seeks class action status for those who purchased items from a DSW store in California since July 8, 2011, and damages more than $5 million, plus court costs. She is represented by attorneys Douglas Caiafa of Douglas Caifa in Los Angeles, and Christopher J. Morosoff of the Law Office of Christopher J. Morosoff in Palm Desert, Calif.
