The makers of a popular dried sausage snack are cited in a class action suit, alleging its packaging misleads consumers
Jaime Lam, Richard Rizzu, Freddie Escobar, David Myers and more than 100 John Does filed the lawsuit April 23 in U.S. District Court Eastern District of New York against Conagra Foods Inc. the makers of the Slim Jim brand.
According to the complaint, Slim Jims are packaged in containers with “non-functional slack-fill,” which violates federal law. Slack-fill is the portion of a container that is empty.
According to the suit, the Slim Jim packaging is about 5 1/4 inches high and 2 1/2 inches long and five-eighths of an inch wide, but the actual product is just under 4 inches long and three-eighths of an inch in diameter. “The size of the box, in comparison to the actual product, makes it appear that the consumer is buying more than what is actually being sold,” the lawsuit says.
The suit seeks class status and more than $5 million in damages, plus court costs. The plaintiffs are represented by attorney C.K. Lee of Lee Litigation Group in New York City.
