N.H. AG reaches agreement with contractor
CONCORD, N.H. (Legal Newsline) - New Hampshire Attorney General Michael Delaney announced on Friday that his office has entered into an assurance of discontinuance with a Litchfield-based contracting business and its owner.
The agreement between Delaney's office and Robert J. Lowry III and Lowry Construction LLC was filed with the Merrimack County Superior Court in Concord and places certain conditions and obligations on Lowry with respect to the operation of his business.
The agreement requires Lowry to discontinue accepting deposits in advance of work to be performed, except for the purchase of supplies for that particular consumer's project. In addition, Lowry must make monthly payments to consumers as set forth in the assurance, file a monthly report with the Consumer Protection and Antitrust Bureau of the monthly payments he has made to consumers, and respond to all consumer complaints that have been forwarded to him by the bureau.
Lowry did not admit any wrongdoing as part of the agreement.
"A violation of the assurance of discontinuance is a prima facie violation of New Hampshire's Consumer Protection Act," Delaney said. "My office believes that this assurance will provide consumers with necessary protections in their business dealings with Lowry, as well as provide them with a method to obtain restitution for goods and services not provided."
