Suthers sues telemarketers

DENVER (Legal Newsline) - Colorado Attorney General John Suthers announced a lawsuit on Thursday against magazine sales telemarketing companies and their principals for alleged deceit and fraud.

Suthers' complaint seeks to bar the 21 defendant companies, including Rocky Mountain Readers Service, and their principals, from engaging in deceptive telemarketing. The lawsuit also seeks restitution for the victims of the alleged fraud and fines related to the action of the companies.

"There is strong evidence that these companies and individuals preyed on the elderly and consumers with cognitive disabilities - society's most vulnerable," Suthers said. "Businesses whose business models are reliant on fraud have no place in Colorado. We look forward to presenting our case against these telemarketing companies."

According to the complaint, the telemarketers contacted consumers who already had subscriptions, pretending to be the company providing the magazines. The defendants allegedly obtained consumers' credit card numbers under false pretenses, offering to lower consumers' subscription payments, when they were actually trying to sign up consumers for new magazine subscriptions at a price of up to $1,298.

The defendants also allegedly shared consumers' financial information amongst themselves to sign consumers up for magazine subscriptions that they had not willingly purchased.

Defendants named in the lawsuit include Raymond Makatura, Robert Makatura, Lucille Makatura, Lucille Aragon, Dorothy Gonzales, Henry Aragon, Nicholas Harper, Rita Rohleder, Michael Brian Patterson, Magazine/One LLC., Promo Readers Service Inc., Readers Choice Service Inc., All City Circulations Inc., Magazine Connection LLC, Magazine Club LLC, Readers Source LLC, Haragon Holdings LLC, Haragon Holdings Inc., Family Publications Inc., Increase Publications LLC, I.N.C. & Associates, N R And Assoc. Inc., Neighborhood Readers and Associates, National Readers and Associates, First Premier Subscriber Services Inc., Crown Marketing Inc., Class Media Inc., H.J.H. LLLC, and World Wide Readers Service Inc.
