Water company admits to wrongdoing in S.D. settlement
PIERRE, S.D. (Legal Newsline) - South Dakota Attorney General Marty Jackley announced that his office has settled with Sioux Falls Quality Water and its owners over alleged deceptive trade practices.
The Division of Consumer Protection first filed a lawsuit against the water company in June 2006, with injunctive terms imposed on SFQW following a consent judgment in May 2007.
When complaints came in this year about SFQW from citizens in South Dakota, Iowa and Minnesota, the Division filed a motion for contempt in May, alleging that SFQW and its owners violated the 2007 consent judgment.
It alleged that the company continued making sales and solicitation visits to homes of consumers without notification or permission, which was a requirement of the judgment.
According to the agreement, SFQW admitted to their wrongdoing, including violating the judgment and collecting payment for merchandise without delivering the product in a timely manner.
The company has agreed to pay a $1,000 civil penalty and will pay an additional $1,000 civil penalty per violation for any future violations.
