Group wants lineup of Col. SC radically changed

Mullarkey

DENVER (Legal Newsline) - Three of the Colorado Supreme Court's justices are up for retention this year, and one group wants voters to send them all packing.

Clear the Bench Colorado wants to oust justices Michael Bender, Alex Martinez and Nancy Rice because they, the group says, have abandoned the Constitution. The three were all appointees of Democratic former Gov. Roy Romer.

The Denver Post recently published an editorial submitted by CTBC founder Matthew Arnold. Colorado's justices face retention elections every 10 years.

Chief Justice Mary Mullarkey, also a Romer-appointee and a target of CTBC, announced last week she would retire rather than take part in her retention election.

The group took issue with decisions that they said increased property taxes, expanded eminent domain property seizures and eliminated certain tax credits and exemptions.
