Iowa AG seeks injunction against supplement company

DES MOINES, Iowa (Legal Newsline) - Iowa Attorney General Tom Miller requested an injunction Friday against a Las Vegas-based health supplement company to stop its Iowa sales and force it to comply with a consumer fraud inquiry.



Miller requested an injunction that would bar Au Naturale Health Solutions; Gerri Bronstein, the company's CEO; and two company employees from telemarketing in Iowa.


Telemarketers with Au Naturale allegedly contacted Iowa consumers to sell phytoplankton capsules and claimed the product would help with or fully reverse more than 500 conditions and afflictions.


One telemarketer allegedly said the capsules of phytoplankton, which are microscopic plant-like underwater organisms, would even cure cancer.


Au Naturale sells phytoplankton capsules, a tropical fruit extract and liquid oxygen drops at $129 per bottle on its website.


In February, Miller's office served Au Naturale and the three individuals with a civil investigative demand that sought information and documents regarding the company, its products and its Iowa consumers.


After allegedly promising to provide the information requested, a company representative provided no response by the agreed-upon deadline.


"Iowa law requires that companies making extraordinary claims for their products be able to substantiate those claims," Miller said. "We're asking a judge to order the company to follow the law by answering our questions, and to bar its telemarketers from calling on Iowans until they've done so."
