Report: Koster suing owners of foam dump business

CAMDENTON, Mo. (Legal Newsline) -- Missouri Attorney General Chris Koster has reportedly filed a lawsuit against the owners of a dock foam dump.

According to LakeExpo.com, Koster sued Michael and Stephanie Duncan, ETC of Missouri Inc., in Camden Circuit Court last week.

The Duncans, whose Greenview-area business collects and resells dock foam, have been charged with four counts: operating without a permit; polluting waters of the state; unlawful solid waste dump; and refusal of access.

LakeExpo.com reported Wednesday that Koster's office also claims Stephanie Duncan interfered with an inspection by the state Department of Natural Resources.

The attorney general is requesting a permanent injunction, prohibiting the defendants from any further violations of the state's Clean Water Act and Solid Waste Management Law; a permanent injunction preventing the defendants from accepting or processing dock foam materials and/or Styrofoam at the site until it is in compliance; and civil penalties ranging from $1,000 to $10,000 a day.

A trial has been set for May 22, according to LakeExpo.com.
