Tenn. AG reaches $325,000 agreement with psychiatrist

NASHVILLE, Tenn. (Legal Newsline) - Tennessee Attorney General Bob Cooper announced a $325,000 agreement on Monday with a Madison psychiatrist who allegedly overbilled Tennessee Medicaid patients for visits.

A.K.M Fakhruddin allegedly overbilled TennCare patients for psychotherapy visits, a practice that is illegal under the Tennessee Medicaid False Claims Act. Under the terms of the settlement, Fakhruddin must pay close to three times the amount he allegedly took from the program.

The TennCare Provider Fraud Task Force alleged that between May 2007 and December 2010, Fakhruddin billed for extensive 45-50 minute psychotherapy visits when he actually performed brief medication management services and minimal psychotherapy.

"In a few instances, he billed for more than 15 hours in a day when the actual time spent with patients was a fraction of that amount," Cooper said. "The Task Force takes very seriously the misuse of taxpayer dollars and will continue to work diligently to end such practices."

Fakhruddin allegedly billed more than 150 patients using the illegal practice.

Fakhruddin denied any wrongdoing as part of the agreement.
