Wis. AG announces erosion control judgments

MADISON, Wis. (Legal Newsline) - Wisconsin Attorney General J.B. Van Hollen announced Monday that his office obtained a $5,000 judgment against two Portage County landowners for allegedly engaging in erosion control violations.

On April 2, 2010, Van Hollen's office filed a civil action against Lexton Properties LLC and HH Condos LLC, two Stevens Point-based companies. Also named as defendants in the action were Thomas J. Ludwig, Ludwig General Contracting LLC and Ludwig Enterprises Inc. The defendants owned property in Portage County known as Echo Dells, North Harmony Village and Harmony Village.

Ludwig, Ludwig General Contracting LLC, Ludwig Enterprises Inc., Lexton Properties LLC and HH Condos LLC allegedly failed to implement and maintain erosion control practices on the Portage County properties in violation of state law.

Erosion control, which is mandated by state law, is needed to protect Wisconsin's streams, rivers and lakes from pollution.

Under the terms of the order, the defendants must pay $5,000 in penalties, forfeitures and fees. The defendants have corrected all the environmental problems listed in the complaint.

Ludwig, Ludwig General Contracting LLC, Ludwig Enterprises Inc., Lexton Properties LLC and HH Condos LLC did not admit criminal or civil liability as part of the order.
