A California engineering company sued a printer manufacturing company on Dec. 3 over allegations of patent infringement.

Innovative Automation Solutions alleged that Epson America, Inc. infringed on its patent for copying digital information onto CDs and DVDs. The lawsuit was filed in a Texas district court due to the defendants operating in the state.

The plaintiff owns a patent, issued in February 2007, for copying digital data from a computer onto CDs and DVDs. Innovative Automation claims Epson infringed on the patent by offering the Epson Discoproducer CD/DVD duplication device.

The device is capable of connecting to a network, which allows the device to copy information from a computer to a CD or DVD, the lawsuit claims.

Additionally, the plaintiffs allege Epson employees violated the patent when they tested the devices and software.

Innovative Automation claims it suffered losses due to the actions of Epson and should be awarded damages. An amount was not specified in the lawsuit, however, the plaintiffs claim the company is entitled to royalties.

Innovative Automation is represented by Todd Kennedy of Gutride Safier, LLP in San Francisco, and Charles Ainsworth of Parker Bunt & Ainsworth in Tyler, Texas.
