LINCOLN, Neb. (Legal Newsline)-Nebraska Attorney General Jon Bruning on Tuesday filed charges against a fuel station and gasoline distributor for allegedly shortchanging motorists at the pump.

The attorney general filed charges following an investigation by the AG's office and the Nebraska Department of Agriculture's Division of Weights and Measures showed that showed two men were selling ethanol-blend gasoline to customers at the higher unleaded price.

"Gas prices are high, times are tough and Nebraskans should get what they pay for," Bruning said in a statement.

Tom Wiese, who owns Scribner Express and Decatur Express, faces three counts of theft by deception, one count of criminal simulation, and one count of deceptive advertising, the attorney general's office said.

Tim Kaup, general manager of the Sapp Bros distribution center in West Point, Neb., is charged with aiding and abetting Wiese in committing seven counts of theft by deception, one count criminal simulation and one count of deceptive advertising.

"We know there are more stations taking advantage of unsuspecting customers," Bruning said. "We intend to prosecute those who deceive the public. If they think they're going to get away with it, they're wrong."
