Asbestos suit can go forward, Arkansas high court rules

LITTLE ROCK, Ark.--A multiple-plaintiff asbestos-related lawsuit recently got the green light in Arkansas.

The Arkansas Supreme Court reversed an earlier circuit court decision to dismiss the claims of several dozen former employees of Georgia-Pacific Resins, Inc. and their family members for damages due to asbestos exposure. The circuit court ruled that the plantiff's claims were not covered by Arkansas' Workers Compensation Act.

But the Supreme Court overruled, holding that only the Workers Compensation Commission (WCC) has jurisdiction to make such judgements. The parties will now pursue the case through the WCC.
